Even though it is fairly simple in theory, legal separation may be a bizarre and confusing concept to some. After all, if it handles many of the same issues as divorce, such as property division, child support and child custody, and in Missouri, where couples must live apart during the waiting period, you may wonder why a couple would seek legal separation instead of simply divorcing.
Of course each couples issues are different, and it is impossible to say why a couple may choose legal separation over divorce or vice versa, but for those who are curious about legal separation, we can answer some of your questions. Perhaps the most pertinent and direct question pertains to the issues that a separation agreement tackles. As mentioned, a separation agreement outlines the rules by which each party must abide during the legal separation, such as child custody and asset division. All of this information will be provided in the separation agreement and will be agreed on by both parties.

As you will notice in the sample separation agreement, both members of the marriage will need to provide their name, as well as important legal information about all children in the marriage, as well as which child will live with which spouse.
