Not just the holidays: Domestic violence a problem all year long

One domestic violence counselor said the phones ring for help all year round. In her experience, there is not an increase around the holidays. Rather, there’s an increase when there are situations where alcohol, drugs and social expectations are involved. Sure, this could be hosting the Christmas dinner, but it can also be any situation where people are gathering and drinking or using drugs.

From a family law perspective, claims of domestic violence can have a real impact on everything from child custody to visitation. In cases where there is violence, an order of protection may be ordered. In these situations, an attorney with experience handling domestic violence cases can not only represent those who have been abused, but can also seek an order to protect things, like possession of a home or child custody.

However, along the same lines that domestic violence should never be tolerated and can play a significant role in family law decisions, keep in mind that there are also plenty of cases where a person is falsely accused of domestic abuse. In these cases, one spouse may lie and claim abuse in order to get the upper hand in a divorce or child custody case.

Either way, whether it’s looking for protection from an abuser or trying to clear one’s name of false accusations, now would be the time to talk with an attorney.
